Terms of Service

1. Agreement

By creating an account or using RaceCopilot (the website, desktop app, or mobile app), you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the service.

2. The service

RaceCopilot provides sim-racing telemetry tools, race data analytics, and an AI race engineer that responds to live session context. Features vary by subscription tier. We may add, change, or remove features as the product evolves.

3. Accounts

You are responsible for keeping your login credentials secure and for all activity under your account. You must provide accurate information and be at least 16 years old (or the minimum age required in your jurisdiction).

4. Subscriptions and billing

• The Pro plan is a recurring subscription billed monthly through Stripe. It renews automatically until you cancel.
• Each billing period includes a monthly AI usage allowance that resets at the start of every period. Unused allowance does not carry over to the next period and has no cash value.
• When your subscription ends — through cancellation or a failed payment — Pro features and the monthly allowance end, and your account reverts to the Free tier.
• You may cancel at any time via the billing portal; access continues until the end of the current billing period.
• Prices are shown inclusive of applicable VAT. Prices may change with reasonable notice; existing subscribers are notified before changes take effect on renewal.
• Refunds are handled on a case-by-case basis unless mandatory consumer law requires otherwise.

Right of withdrawal (EU/EEA consumers)

As a digital service supplied immediately, you would normally have 14 days to withdraw from your purchase under the EU Consumer Rights Directive and the Austrian Fern- und Auswärtsgeschäfte-Gesetz (FAGG). By requesting immediate access to RaceCopilot Pro at checkout, you expressly consent to us beginning to provide the service straight away and acknowledge that you thereby lose your 14-day right of withdrawal for the service already provided. Where the right of withdrawal still applies, contact us to exercise it.

5. Acceptable use

You agree not to:

• abuse, reverse-engineer, or circumvent usage limits or API protections;
• share account access or resell the service without permission;
• use the service for unlawful purposes or to harass others;
• attempt to extract or misuse our models, prompts, or proprietary strategy logic.

6. AI disclaimer

AI-generated race strategy and voice calls are suggestions only. They may be incorrect or incomplete. You remain solely responsible for in-game decisions. RaceCopilot is not affiliated with Formula 1, EA Sports, or any racing series or game publisher.

7. Intellectual property

RaceCopilot, its branding, software, and content are owned by us or our licensors. You receive a limited, non-exclusive licence to use the service for personal sim-racing purposes. Your race data remains yours; you grant us a licence to process it only as needed to provide the service.

8. Availability

We aim for high availability but do not guarantee uninterrupted service. Maintenance, game updates, UDP changes, or third-party API outages may affect functionality. Beta features are provided "as is" without warranty.

9. Limitation of liability

To the maximum extent permitted by law, RaceCopilot is not liable for indirect, incidental, or consequential damages, including lost race positions, in-game penalties, or data loss. Our total liability for any claim is limited to the amount you paid us in the twelve months before the claim.

10. Termination

We may suspend or terminate accounts that violate these terms. You may delete your account at any time by contacting support. Sections that by nature should survive (liability limits, IP, governing law) remain in effect after termination.

11. Governing law

These terms are governed by the laws of Austria, without regard to conflict-of-law principles. EU consumers retain mandatory protections under the laws of their country of residence.
